The Securities and Futures Commission (SFC) has applied to the High Court for an order to force Lehman Brothers Asia to produce records in connection with its Minibonds investigation.
The SFC is trying to force Lehman Brothers Asia (which is in liquidation) to produce the records following an objection by lawyers for Lehman Brothers to an earlier Notice served by the SFC.
Lehman Brothers lawyers produced some documents but objected to the production of 17 others on the grounds they were the subject of a claim of legal professional privilege.
The objection was based around the fact a member of the SFC's New Product Review Committee was an in-house lawyer at Lehman Brothers.
Discussions between the SFC, the liquidators of Lehman Brothers and their lawyers had been ongoing since December 2008. The case has been scheduled for 22 July 2009.
